Understanding Military vs. Civilian Justice Systems

While there is some overlap between civilian and military crimes, there are significant differences between the civilian justice system and the military justice system. Based upon the Uniform Code of Military Justice (UCMJ), the military justice system is complex and it differs from every other type of justice system in the United States. There are three different types of courts-martial where service members in the Army, Air Force, Navy and Marines can be charged with military crimes. These are the summarized court-martial, special court-martial and general courts-martial. Different from the civilian system, in the military justice system, commanders, not prosecutors, are the individuals who charge service members with crimes.

Similar to the civilian system, service members who are facing court-martial have the right to hire a military defense lawyer instead of being represented by their appointed military attorney.
