Both state and federal laws require employers to provide women with break time where they can express breast milk. Not only are employers required to provide women with break time to express breast milk, employers are also required to provide women with a private, sanitary location, usually with an electrical outlet, where they can pump. Moreover, it is unlawful for an employer to require women to pump their breast milk in a public restroom or bathroom.
Despite these laws, many employers make no attempt to accommodate female employee’s breast pumping needs. This can result in decreased breast milk supply, emotional distress, increased risk of health effects to the mother later in life and increased risks of lifelong health effects to their child. It is for these reasons that the state and federal government have enacted laws protecting a mother’s right to express breast milk while at work.
