What Is Considered a Felony DUI in Colorado?
In Colorado, a DUI (Driving Under the Influence) is typically a misdemeanor offense. However, under specific circumstances, a DUI can be elevated to a felony charge, carrying significantly harsher penalties.
A DUI can become a felony in Colorado if it meets one of the following criteria:
- Fourth or subsequent DUI convictions: If you have three prior DUI convictions, a fourth DUI offense will be charged as a felony. This applies regardless of whether the previous offenses were misdemeanors or felonies.
- DUIs that lead to serious bodily injuries: If your impaired driving results in serious bodily injury to another person, it is a felony offense, known as vehicular assault.
- DUIs that cause death: If your impaired driving results in the death of another person, it is a felony offense, known as vehicular homicide.
- DUIs involving an extremely high BAC and past convictions: In some cases, a DUI with an extremely high blood alcohol content (BAC) of 0.15% or higher, combined with prior DUI convictions, can be charged as a felony.
