Felony Classes & Penalties in Colorado 

There are six classes of felonies in Colorado and four separate classifications for drug felonies. However, it is important to note that, under Colorado Revised Statutes sections 18-1.3-401 and 18-1.3-406, certain violent crimes and crimes involving extraordinary risk of harm face harsher penalties. 

The felony classifications are as follows: 

  • Class 1 felonies, like treason and first-degree murder, are punishable by life imprisonment. 
  • Class 2 felonies, like theft of assets worth $1 million or more and kidnapping, are punishable by eight to 24 years of imprisonment and three years of mandatory parole; crimes of violence that are Class 2 felonies are punishable by 16 to 48 years with five years of mandatory parole. Fines for this type of felony range from $5,000 to $1,000,000 fine.
  • Class 3 felonies, like first-degree arson and aggravated robbery, are punishable by four to 12 years of imprisonment and three years of mandatory parole; crimes of violence are punishable by 10 to 32 years with five years of mandatory parole, while extraordinary risk crimes face four to 16 years with five years of mandatory parole. Fines for these felonies range from $3,000 to $750,000.
  • Class 4 felonies, like stalking in violation of a protection order, are punishable by two to six years of imprisonment and three years of mandatory parole; crimes of violence face five to 16 years with three years of mandatory parole, while extraordinary risk crimes face two to eight years with three years of mandatory parole. Fines for these felonies range from $2,000 to $500,000.
  • Class 5 felonies, like forgery, are punishable by one to three years of imprisonment and two years of mandatory parole; crimes of violence face 30 months to eight years with three years of mandatory parole, while extraordinary risk crimes face one to four years with two years of mandatory parole. Fines for these felonies range from $1,000 to $100,000.
  • Class 6 felonies, like unlawful electronic sexual communication, are punishable by 12 to 18 months of imprisonment and one year of mandatory parole; crimes of violence face 18 months to four years, while extraordinary risk crimes face one to two years. Fines for these felonies range from $1,000 to $100,000.

Colorado felony drug offenses are classified and penalized as follows: 

  • Level 1 drug felonies are punishable by eight to 32 years of imprisonment, three years of mandatory parole, and fines ranging from $5,000 to $1,000,000.
  • Level 2 drug felonies are punishable by four to eight years of imprisonment (eight to 14 years in aggravated cases), two years of mandatory parole, and fines ranging from $3,000 to $750,000.
  • Level 3 drug felonies are punishable by two to four years of imprisonment (four to six years in aggravated cases), one year of mandatory parole, and fines ranging from $2,000 to $500,000.
  • Level 4 drug felonies are punishable by six to 12 months of imprisonment (one to two years in aggravated cases), one year of mandatory parole, and fines ranging from $1,000 to $100,000.
